Environmental Due Dilligence

ENAC performs environmental due diligence to evaluate a property's environmental condition and assessing potential liability for any contamination. Whether it is a small, medium or large scale property transaction for commercial, industrial or residential use, ENAC will identify existing conditions and research past use of the property to identify any environmental risk associated with the property.

Most commercial assessments follow the American Society Testing Materials (ASTM) Practice E1527 for Phase I Environmental Site Assessments (ESAs) and the newly established Environmental Protection Agency (EPA) All Appropriate Inquiry (AAI) provided in Code of Federal Regulation 40 CFR 312.

Depending on size and current and past use of the property, the environmental due diligence to obtain certain protections from liability under the federal Superfund Law Comprehensive Environmental Response Compensation and Liability Act (CERCLA) can range from a peer review of documents if past contamination has existed, a Transaction Screen Process to evaluate a low environmental risk, or a Phase I ESA to evaluate a more detailed property assessment. In some cases ENAC recommends establishing a base-line environmental condition, including site investigation activities to document soil and ground water quality beneath a property.

  • Phase I Environmental Site Assessment (ASTM 1527) and EPA All Appropriate Inquiry (AAI) 40 CFR 312.
  • Peer review of contaminated sites and ESAs performed by others.
  • Site Investigation activities to identify a base-line environmental property condition.
